Ordinary, and Immediately Enforceable
The ordinary order for payment is applied for on a simple statement of claim; the court issues it and the debtor has a period to object, with an objection suspending enforcement and pushing the matter into ordinary proceedings.
The second route applies where the claim is founded on a qualifying document - categories defined by statute, including certain notarised instruments and extracts from the accounting records of particular institutions. There the court issues a writ of immediate execution: enforcement can commence while any objection is dealt with separately, and the debtor must apply specifically to have execution stayed.
Which route is open depends entirely on the documentation. Establishing that is the first step on a Bulgarian file, and it changes the timetable by months.
Private Agents Alongside the State
Bulgaria operates private enforcement agents in parallel with state bailiffs. Private agents are remunerated from the process, hold access to banking and registry data, and can be selected by the creditor.
For a foreign creditor the practical difference is engagement: a private agent whose fee depends on recovery will chase accounts and receivables actively, where a state bailiff carrying a large caseload may not. Choosing the agent is a decision worth making rather than defaulting.
Shorter Than the General Rule
Bulgarian law applies a three-year period to claims for periodic payments and certain categories including remuneration, against a five-year general period. Because supply relationships often generate what is characterised as periodic payment, the shorter figure applies more often than a foreign creditor expects.
An aged Bulgarian receivable should therefore be assessed against the three-year period first. Commencing the order-for-payment procedure interrupts limitation; correspondence does not.
