Civil claims are heard by the Juzgados de Primera Instancia, with insolvency and certain commercial matters going to the Juzgados de lo Mercantil. Procedure is governed by the Ley de Enjuiciamiento Civil, and enforcement proceeds by embargo - attachment of bank accounts, receivables or property. As an EU member state it also opens the European Order for Payment and European Enforcement Order to creditors elsewhere in the Union.
Proceso Monitorio
The proceso monitorio is a documentary order-for-payment procedure with no upper limit on claim value - a feature that distinguishes it from equivalents in several neighbouring systems and makes it usable on substantial commercial debts, not only small ones.
On a valid application the court requires the debtor to pay or oppose within twenty days. Silence produces an enforceable title. Opposition converts the matter into ordinary proceedings, with the track depending on value. Where the debt is evidenced by a bill of exchange, promissory note or cheque, the juicio cambiario offers an alternative that allows preventive attachment at an early stage.
Statutory Interest Under Ley 3/2004
Spain implements the Late Payment Directive through Ley 3/2004. Statutory interest on late B2B payment runs at the ECB reference rate plus eight percentage points, with a fixed €40 recovery indemnity and reasonable additional recovery costs. The legislation also constrains how far payment terms can be extended by agreement, which matters where a debtor has unilaterally imposed long terms.

Five Years - and the 2015 Cut
The limitation period for ordinary personal actions was reduced from fifteen years to five by the 2015 reform of the Civil Code. Claims that predate the reform are governed by transitional rules, so a genuinely old Spanish receivable is not automatically time-barred - but it does need to be assessed rather than assumed. For anything arising since, five years is the working figure.
