Why Courts Are Not the Route
Formal judicial capacity for cross-border commercial claims is limited and uneven, and varies considerably between Mogadishu, Puntland and Somaliland, which operate distinct administrations. A foreign creditor budgeting for litigation in Somalia is, in almost every case, budgeting for nothing.
What exists instead is an old and functional set of alternatives: resolution through chambers of commerce and business associations, through respected intermediaries within the trading community, and through customary arbitration mechanisms whose determinations carry social weight even without state enforcement. These are not a poor substitute for a court in this market - for the traders themselves they are the primary system.
Reputation Within the Network
Somali trade is conducted across an unusually connected diaspora network spanning the Gulf, East Africa, Europe and North America, in which suppliers, financiers and intermediaries know one another and information about a default travels fast.
A merchant who intends to keep importing cannot afford to be known as one who did not pay a foreign supplier. That gives a well-documented, calmly presented claim, raised through the right channel, considerably more force than its legal position alone would suggest. Conversely, an aggressive or public approach that causes loss of face tends to harden a position that was otherwise negotiable.
Identifying the right intermediary - the person or institution the debtor cannot easily dismiss - is the substantive work on a Somali file.
Remittance Channels and Compliance
Payments move principally through money transfer and remittance operators rather than through conventional correspondent banking, and the US dollar is the practical currency of wholesale trade.
This creates a compliance dimension that a creditor must address before, not after, agreeing a settlement. Your own bank's requirements on the source and route of funds may be more restrictive than the transfer itself, and a payment that cannot be received cleanly is not a recovery. We screen the counterparty and identify a workable route as part of the assessment.

Berbera, Bosaso and Mogadishu
Commercial activity concentrates around the ports, with Berbera in Somaliland developed as a regional gateway including Ethiopian transit traffic, alongside Bosaso and Mogadishu.
Regional differences are practical rather than cosmetic. A counterparty operating out of Hargeisa or Berbera sits within the Somaliland administration and its own commercial institutions, and the intermediaries and associations relevant to a claim there are different from those in Mogadishu.
