Paraguay's border trade, concentrated around Ciudad del Este on the Brazilian frontier, moves very large volumes of electronics, consumer goods and components onward into neighbouring markets. A Paraguayan importer in that trade may hold stock for days rather than months.
The recovery implication is about timing rather than law. Where goods have been on-sold across a border, neither the stock nor the receivable remains within reach of a Paraguayan judgment, and the value may sit with a Brazilian or Argentine buyer who has no contractual relationship with you. Establishing this early determines whether a Paraguayan claim is worth bringing at all, or whether the better target is elsewhere.
Executive Proceedings
Where the debt is documented by a título ejecutivo - a pagaré, a conformed invoice or comparable instrument - the juicio ejecutivo allows attachment to be ordered at the outset with the debtor's defences confined by statute.
Given how quickly assets move in border trade, obtaining attachment early is worth considerably more here than in a market where the debtor holds stock and premises. Where no executive title exists, the ordinary route requires the claim to be proved first, by which point there is frequently nothing to attach.
Commercial Prescription
Prescription varies by the nature of the obligation, with commercial claims and actions on instruments carrying periods distinct from ordinary civil obligations. As across the region, an instrument left unenforced can lose its executive character while the underlying claim survives by a slower route.
Guaraní and Regional Settlement
Claims are typically denominated in guaraní, and conversion and transfer are ordinary banking operations without the allocation regimes seen elsewhere. Paraguay does not impose the exchange controls that complicate recovery in Argentina.
Where the debtor's onward sales generate Brazilian or Argentine receivables, however, the practical settlement discussion may involve currencies and counterparties outside Paraguay entirely.
