Courts, Mediation and Execution
Commercial claims go to the Courts of First Instance, with lower-value matters before the Magistrate Courts. Jordan has introduced mediation as a stage in civil proceedings, with disputes referred to it before trial - a screening mechanism that resolves a meaningful proportion of commercial matters.
Proceedings are conducted in Arabic, and documents in other languages require certified translation, with legalisation for material executed abroad.
Cheques and Written Undertakings
Jordanian commercial practice makes heavy use of cheques and signed undertakings as payment security, and these instruments carry consequences beyond an ordinary contractual debt. A dishonoured cheque opens routes that an unpaid invoice does not, both in terms of the procedure available and the pressure it generates.
For a supplier the practical point is at the front end: where a Jordanian counterparty offers a post-dated cheque against an order, that is worth accepting rather than declining as informal. It converts a future dispute about whether the debt exists into a question about why the instrument was not honoured.
Where the Pressure Comes From
Once an enforceable instrument exists, the execution department takes over. Its powers include attaching bank accounts, salaries and property, restricting the debtor's dealings and, in defined circumstances and subject to statutory conditions and exemptions, coercive measures directed at the individual debtor.
The result is that enforcement in Jordan produces outcomes where enforcement elsewhere in the region produces correspondence. It also means the process carries consequences that warrant a proportionate approach, and we assess each file on that basis rather than escalating by default.
Commercial Obligations
Limitation periods depend on how the obligation is characterised, with commercial obligations and claims on negotiable instruments subject to their own periods distinct from the general civil rule. An aged Jordanian receivable should be assessed against the applicable category rather than a headline figure.
