Oral Procedure and the Monitorio
Costa Rica's procedural overhaul replaced a largely written system with oral hearings and introduced a monitorio procedure for claims founded on documents. The monitorio allows an order to be sought on documentary application, with the debtor bearing the burden of opposing within a defined period.
The change addressed a system whose delays had become a genuine deterrent to foreign creditors. Timetables are now materially shorter, and a documented supply claim is a realistic proposition rather than an exercise in patience.
Free Zone Manufacturing
Costa Rica's export base is dominated by free zone manufacturing - medical devices, precision instruments and electronics produced for North American and European markets - alongside agricultural exports and a substantial services sector.
Free zone operators earn foreign currency and hold accounts accordingly, which places them in a different settlement position from a domestic company earning colones. Where your debtor is a zone operator, structuring a settlement against export receipts avoids the conversion question entirely.
Commercial Prescription
Prescription depends on the nature of the obligation, with commercial claims and actions on instruments carrying periods distinct from ordinary civil obligations. As across Latin America, an instrument left unenforced may lose its executive character while the underlying claim survives by a slower route.
Colón and Conversion
The colón operates within a managed regime and conversion and transfer of a recovery are ordinary banking operations with trade documentation. Costa Rica does not impose the allocation systems that constrain recovery in parts of the region, so the currency dimension is administrative rather than structural.
After Judgment
Enforcement proceeds through attachment of bank accounts, receivables and property. The procedural reform improved the enforcement stage as well as the trial stage, though execution against a debtor with no identifiable assets remains as unproductive here as anywhere.
Where the debtor is a free zone operator, its export receivables are the most reachable asset and worth identifying before enforcement begins.
How Long Does a Costa Rican Claim Take?
| Stage | Typical Duration | Cost |
|---|---|---|
| Formal demand Written demand in Spanish, negotiation | 2–5 weeks | Low |
| Monitorio Documentary application, opposition window | 3–8 months | Low |
| Ordinary oral proceedings Where the debtor opposes | 1–2 years | High |
| Enforcement Attachment and realisation | 4–10 months | Medium |
How Does SXB Global Handle a Costa Rican Case?
We establish whether the debtor is a free zone operator with foreign currency receipts, because that shapes what a settlement can look like. Where the documentation supports it we use the monitorio, which since the reform is a genuinely quick route rather than a nominal one. Where legal proceedings become appropriate, SXB Global coordinates the instruction of appropriately authorised local counsel. Legal services are provided by the relevant independent legal professionals.
