Debt Collection in Mozambique

Mozambique's commercial credit exposure divides sharply between two worlds: the large resource projects in the north and the Beira and Nacala corridor trade serving landlocked neighbours. A supplier's recovery prospects depend almost entirely on which of the two its debtor belongs to, because the counterparties, the payment cycles and the currency positions are entirely different.

Projects and Corridors

Northern Mozambique hosts substantial LNG and mining developments with international operators and layered contractor chains. A supplier several tiers into one of those chains faces institutional payment cycles, certification requirements and occasional project-level suspensions that stop payment all the way down.

Separately, the Beira and Nacala corridors carry trade to and from Zimbabwe, Zambia, Malawi and the DRC, and generate a very different counterparty base of logistics operators, clearing agents and traders whose cashflow depends on transit volumes rather than project schedules.

The first question on a Mozambican file is which of these your debtor is. The answer determines everything about the approach.

Portuguese Legal Inheritance

Mozambique's civil and commercial law derives from the Portuguese tradition, so obligations, prescription and documentary procedures follow a pattern recognisable to European advisers. Proceedings are conducted in Portuguese.

That familiarity reduces the cost of assessing a claim, though institutional capacity means contested proceedings run long. For most foreign creditors the realistic path is a documented settlement rather than a judgment.

Metical Access

Conversion and outbound transfer of a recovery are subject to the applicable framework and require documentation evidencing the underlying trade, with availability varying. A settlement in metical is not a settlement received.

Project-chain counterparties frequently have access to foreign currency through the operator's arrangements, which makes structuring against those receipts the practical route. Corridor traders are more likely to be constrained.

Prescription

Prescription follows the Portuguese-derived pattern with an ordinary period and shorter periods for particular categories. As in Angola, the ordinary period is comparatively long, so an aged Mozambican receivable is frequently still actionable - though the practical prospects decline as project chains restructure.

How Does SXB Global Handle a Mozambican Case?

We classify the debtor before doing anything else, because a project contractor and a corridor trader require opposite approaches - documentation and routing for one, speed for the other. Contact is conducted in Portuguese, and settlement currency is addressed as a term rather than an assumption. Where legal proceedings become appropriate, SXB Global coordinates the instruction of appropriately authorised local counsel. Legal services are provided by the relevant independent legal professionals.

The Gas Chain and Progress Certification

The large northern gas developments run through international operators and their contractors. For a supplier of goods or services into that chain the issues are contractual rather than financial: acceptance, progress certification, retention and variation orders.

Against counterparties of that kind ability to pay is not in question - the obstacle is the approval process. Without the acceptance record and the progress correspondence it cannot be established whether the debt has fallen due at all, so we ask for those documents alongside the invoice. General trade outside the project chain behaves in an entirely different way and is assessed separately.

Mozambique - FAQ

Why does it matter which sector my debtor is in?+
Because a supplier to an LNG or mining chain faces institutional payment cycles and certification requirements, while a corridor logistics operator's cashflow depends on transit volumes. The counterparties, timelines and currency positions are entirely different.
Is the legal system familiar?+
Reasonably. Mozambique's civil and commercial law derives from the Portuguese tradition, so obligations, prescription and documentary procedures follow a recognisable pattern. Proceedings are in Portuguese and contested matters run long.
Can I be paid in foreign currency?+
Project chain counterparties often can, through the operator's arrangements, which makes structuring against those receipts the practical route. Corridor traders are more likely to be constrained, and the settlement should address currency expressly.
Does SXB Global litigate in Mozambique?+
No. We are a commercial debt recovery and receivables management consultancy, not a law firm, and we do not provide legal advice or legal representation. Where legal proceedings become appropriate, we coordinate the instruction of appropriately authorised local counsel; legal services are provided by those independent legal professionals.
