Reform and Its Effects
Albania's justice reform involved individually vetting judges and prosecutors on integrity, assets and professional criteria. A substantial number left the profession as a result, and the courts have operated with reduced capacity while replacements are appointed and trained.
The direction is positive and the reform was necessary, but a creditor planning a recovery today should assume that a contested court process will be slow. That makes documentary enforcement routes, and settlement, correspondingly more valuable.
Execution Without a Trial
Albanian law recognises categories of executive title that permit enforcement without a prior judgment - notarised acts and certain other qualifying documents among them. Where such a document exists, the creditor applies for an execution order and proceeds directly to a bailiff.
For a supplier trading regularly into Albania, having significant agreements executed in notarial form is therefore a high-return decision: it converts a slow court process into an administrative one, and it does so precisely where the court route is weakest.
A Private Bailiff Service
Enforcement is carried out by private bailiffs operating alongside the state service, licensed and remunerated from the process. A creditor may choose whom to instruct, and track records vary meaningfully.
Bailiffs can attach accounts, receivables and property. As in neighbouring systems, the profession is where most of the practical energy in Albanian recovery sits.
Limitation by Category
The Civil Code applies limitation periods varying by the nature of the obligation, with commercial and periodic claims subject to shorter periods than general civil obligations. Given the pace of contested proceedings, a claim brought late in its period leaves no room for the delays that follow.
